Artist Warranties, Rights and Indemnity

1. Ownership and Rights Warranty

By submitting any music, audio recordings, artwork, metadata, biography, or related content to Pure AI Radio, the submitting artist, producer, or representative, referred to as "the Artist", represents and warrants that:

• The Artist is the sole legal owner of the submitted content, or has obtained all necessary rights, licenses, consents, and permissions required to distribute, broadcast, stream, and otherwise make the content publicly available through Pure AI Radio.
• The content does not infringe upon any copyright, neighboring rights, trademark, moral rights, performance rights, publicity rights, or any other intellectual property or proprietary rights of any third party.
• The content does not contain any unlawful, defamatory, obscene, or otherwise illegal material.

ARTIST OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS

All artists and creators submitting music, recordings, artwork or associated material to Pure AI Radio retain full ownership of any intellectual property rights they legally hold in their submitted content. Submission of music to Pure AI Radio does not constitute a transfer, assignment or sale of copyright, ownership or other intellectual property rights to the station.

Artists remain free to publish, distribute, licence, sell or broadcast their original works through other services, platforms or media outlets without restriction from Pure AI Radio. Where material has been created or assisted by artificial intelligence, ownership and copyright protection remain subject to the applicable laws and the terms of the AI services used in its creation.

By submitting content, the artist confirms that they own or control the necessary rights, permissions and authorisations to permit Pure AI Radio to use the material for its intended broadcasting purposes. Pure AI Radio reserves the right to accept, reject, suspend or remove submitted material at its discretion in accordance with the station's content standards and Terms and Conditions.

BROADCASTING LICENCE AND PERMITTED USE

By submitting music or audio recordings for airplay, the artist grants Pure AI Radio a non-exclusive, worldwide, royalty-free licence, to the extent that the artist is legally entitled to grant such permission, to store, process, reproduce as technically necessary, and publicly stream approved recordings as part of the Pure AI Radio internet broadcasting service.

This licence applies to the station's official streaming infrastructure, website, authorised radio players, mobile listening services and third-party radio directories that carry or provide access to the Pure AI Radio broadcast stream.

The licence also permits Pure AI Radio to identify the artist and song title and display submitted cover artwork and associated promotional information in connection with the station's broadcasts, playlists and programme promotion.

The permission granted is strictly limited to the operation, management and promotion of Pure AI Radio and its associated radio broadcasting services.

Pure AI Radio does not acquire the right to sell, commercially release, independently distribute or sublicense individual artist recordings to third parties for unrelated purposes without the artist's separate written authorisation.

Nothing in this agreement prevents the artist from distributing or licensing their music independently to other radio stations, streaming services, digital distributors or commercial platforms.

The artist remains responsible for ensuring that all necessary permissions, including any applicable third-party rights, have been obtained before submitting material for broadcast.

2. No Liability for Submitted Content

Pure AI Radio acts solely as a streaming and promotional platform. Pure AI Radio does not verify ownership of submitted content and relies entirely on the representations made by the Artist.

Pure AI Radio accepts no responsibility or liability for any disputes, claims, damages, losses, legal proceedings, or costs arising from:

• Ownership disputes between artists, producers, collaborators, or third parties.
• Allegations of copyright infringement or unauthorized use of content.
• Any misrepresentation made by the Artist regarding rights or permissions.

All responsibility for the submitted content remains solely with the Artist uploading the content.

3. Indemnification

The Artist agrees to indemnify, defend, and hold harmless Pure AI Radio, its owner, operators, affiliates, and representatives from and against any and all claims, liabilities, damages, losses, expenses, or legal fees arising out of or related to:

• Any breach of the warranties set out above.
• Any claim that the submitted content infringes the rights of any third party.
• Any dispute between collaborators, contributors, or rights holders connected to the submitted content.

4. Right to Remove Content

Pure AI Radio reserves the right, at its sole discretion and without prior notice, to remove any content that is subject to a dispute, claim, or allegation of infringement, or that Pure AI Radio reasonably believes may expose the station to legal risk.

5. ARTIST'S RIGHTS TO REMOVE CONTENT

Pure AI Radio respects the rights of artists and creators to manage their own musical works. Artists are under no contractual obligation to keep their music in the station's broadcast rotation indefinitely.

Removal or Replacement of Individual Songs

Registered artists may request the removal or replacement of individual songs in accordance with the station's current submission allowances, processing arrangements and playlist management policies.

The removal or replacement of an individual recording does not constitute termination of the artist's registration or relationship with Pure AI Radio.

All replacement submissions remain subject to the station's normal review and approval process.

Voluntary Withdrawal from Pure AI Radio

An artist who wishes to withdraw completely from Pure AI Radio may submit a formal written request to the Station Manager using their registered email address.

Following verification and confirmation of the request, Pure AI Radio will remove the artist's submitted recordings from active broadcast rotation and remove associated public-facing artist material maintained solely as part of the station's service.

Voluntary withdrawal terminates the artist's active registration and associated broadcasting permissions. It does not automatically prevent the artist from applying for registration again in the future.

Any subsequent application will be considered under the registration requirements and policies in effect at that time. Previous registration or acceptance does not guarantee future approval.

Suspension or Termination by Station Management

Pure AI Radio reserves the right to suspend or permanently terminate an artist's registration where there has been a serious or repeated breach of station rules, copyright infringement, misrepresentation, fraudulent activity, abusive conduct or other behaviour that may compromise the station's integrity, reputation or legal obligations.

In such circumstances, Pure AI Radio may refuse future registration or submissions from the artist.

All registration, content acceptance, suspension and termination decisions remain at the discretion of Pure AI Radio management, subject to applicable law.

Administrative Records

Following withdrawal, Pure AI Radio may retain limited internal administrative records where reasonably required for legal compliance, dispute resolution, fraud prevention or legitimate operational purposes, in accordance with its Privacy Policy and applicable law.

Such retention does not authorise continued public broadcasting of withdrawn recordings.

6. Duration and Termination of Broadcasting Licence

The broadcasting licence granted to Pure AI Radio begins when a submitted recording is accepted and approved for use by the station.

The licence remains valid for as long as the recording is retained as an approved part of the station's broadcasting service, unless terminated earlier in accordance with these Terms and Conditions.

Termination of Individual Song Permissions

Where an artist requests the permanent withdrawal of an individual recording, Pure AI Radio's permission to broadcast that recording will terminate upon confirmation that the recording has been removed from the station's active broadcasting system.

Removal from regular playlist rotation alone does not necessarily constitute permanent withdrawal where a recording remains approved for use in scheduled programmes, archived broadcasts or other authorised station content.

Termination Following Complete Artist Withdrawal

Where an artist requests complete withdrawal from Pure AI Radio, broadcasting permissions for all recordings covered by that withdrawal will terminate once their removal from the station's active broadcasting system has been confirmed.

Following termination, Pure AI Radio will not initiate further broadcasts of the withdrawn recordings without obtaining renewed permission from the artist or other authorised rights holder.

Technical Storage and Previous Broadcasts

Pure AI Radio may retain limited backup copies or administrative records where reasonably necessary for system recovery, legal compliance or legitimate operational purposes. Any retained recordings will not be used for further public broadcasting after termination of the relevant licence.

Termination does not retrospectively affect broadcasts lawfully completed before withdrawal.

Pure AI Radio will make reasonable efforts to remove withdrawn material from services under its direct control and to notify relevant third-party service providers where removal is required and technically possible.

The station cannot guarantee the immediate removal of independently cached material or copies retained by unauthorised third parties outside its control.

Hyperlinking to our Content

The following organizations may link to our Website without prior written approval:

• Government agencies;
• Search engines;
• News organizations;
• Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and
• System-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.

These organizations may link to our home page, to publications, or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site.

We may consider and approve other link requests from the following types of organizations:

• Commonly-known consumer and/or business information sources;
• Dot.com community sites;
• Associations or other groups representing charities;
• Online directory distributors;
• Internet portals;
• Accounting, law, and consulting firms; and

We will approve link requests from these organizations if we decide that: (a) the link would not make us look unfavorably to ourselves or to our accredited businesses; (b) the organization does not have any negative records with us; (c) the benefit to us from the visibility of the hyperlink compensates the absence of Pure AI Radio; and (d) the link is in the context of general resource information.

These organizations may link to our home page so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to Pure AI Radio. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. Legal Contact Information

As a condition of registration and continued membership with Pure AI Radio, all creators and account holders are required to provide their full legal name, including first name and surname. Artist names, stage names, aliases, personas, or other professional identities must not be used in place of your legal identity for registration purposes.

This information is required for administrative, legal, and intellectual property compliance purposes. In the event that Pure AI Radio receives a valid legal request, court order, subpoena, or other lawful direction from an authorised agency or regulatory body concerning alleged copyright, intellectual property, or other legal infringements, Pure AI Radio may be required to provide information relating to the relevant creator or account holder.

Your legal name will not be publicly displayed as your artist identity unless otherwise agreed or legally required.

Failure to provide accurate legal identification, or knowingly providing false or misleading information, may result in the suspension or cancellation of your Pure AI Radio registration, membership, and associated services.

Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly.

We do not ensure that the information on this website is correct. We do not warrant its completeness or accuracy, nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

Supporting Pure AI Radio

Contributions to support Pure AI Radio are entirely voluntary. Donations do not guarantee song acceptance, playlist placement, additional airplay, priority processing, or promotional services. Pure AI Radio is not representing these contributions as tax-deductible charitable donations.

Artist administration contribution

Artists submitting a larger volume of material may be asked to make a $25 administration contribution toward the additional processing, review, metadata management, and station administration involved. Payment does not guarantee that any song will be accepted, added to the playlist, or played for any particular period. All submissions remain subject to Pure AI Radio's independent selection standards.

Artist Submissions and Voluntary Administrative Contributions

Artists are under no obligation to purchase services or make any payment to Pure AI Radio as a condition of submitting music under the station's standard submission arrangements.

Each registered creator may submit up to two songs for consideration free of charge. Songs accepted by Pure AI Radio may be added to the station's daily rotational playlist, subject to the station's independent review, selection criteria, programming requirements, and available playlist capacity.

A creator may request the submission and processing of additional songs, up to a maximum of eight songs in total. Due to the additional review, administration, metadata management, and processing involved, Pure AI Radio may invite the creator to make a voluntary contribution of $25 toward the station's administrative and operational costs.

Any such contribution is voluntary and does not guarantee that a submission will be reviewed, accepted, added to the playlist, retained in rotation, given priority treatment, or played with any particular frequency. Pure AI Radio reserves the right to decline or defer additional submissions where the associated work would place an unreasonable demand on station resources, administration time, playlist capacity, or operational requirements. Any decision to decline or defer a submission will be made independently of whether the artist has made a voluntary contribution.

Pure AI Radio may lawfully receive voluntary financial contributions, subject to all applicable New Zealand taxation, accounting, consumer protection, and reporting requirements. Pure AI Radio maintains appropriate financial records and declares income, contributions, and service-related payments to Inland Revenue as required by law.

Nothing in this provision creates a contractual entitlement to playlist inclusion, airplay, promotion, priority processing, or any other service.
